Ordinance Purpose and Overview
The BYOB ordinance was passed by City Council on January 11, 2022 to regulate establishments that allow patrons to bring their own beverage/bottle (BYOB) for consumption at their establishment. Each establishment that allows BYOB must apply for a permit with the City of Carrollton Environmental Services Department, however there are NO fees associated with this permit. The permit will be valid for 1 year and must be renewed every year. For food establishments, this permit will be renewed in conjunction with the annual food establishment permit.
Permit Requirements
- BYOB establishments must follow all applicable city ordinances and laws of the state of Texas. At least one applicant listed on the application must reside within 150 miles of the City of Carrollton.
- Applicants or designated agents may not have a conviction for a felony or misdemeanor that directly relates to the duties and responsibilities for operating a BYOB establishment including regulated substances.
- BYOB locations must close between 2:00am and 7:00am Monday through Saturday and 2:00am-noon on Sunday. Patrons may not remain on the premises nor consume alcohol later than 2:15am. All alcohol consumption must be in the designated areas of the building; at no time shall alcohol consumption be allowed in the parking areas or by persons under the age of 21.
Application Information Required
- Names, addresses, and birth dates for all individuals who have an ownership in or who will manage or exercise control over the BYOB venue;
- Name, addresses, phone number of all property owners upon which the BYOB venue is located;
- Name and address of the BYOB venue; and
- Consent for the city to run background checks on all applicants listed on the permit application.
- For applicants that are a legal entity:
- Evidence from the Secretary of State that demonstrates that the entity is authorized to operate in Texas (ex. Copy of the Tax ID);
- Proof of residency within the state of Texas and within 150 miles of the territorial limits of the City of Carrollton and includes the address of the residence of such individual; and
- Designation of an agent who is a citizen of Texas, to represent the person in matters before the Board and to be responsible for the proper conduct of any activity of a Permit Holder.
Documents to be submitted with the application:
- Scale drawings of the site which includes site improvements, floor plan of each building, and the designated areas where consumption of alcohol is allowed.
- If an applicant does not own the property upon which the BYOB venue is located, then a property owner consent form signed and notarized by the owner of record of the property is required.
BYOB Application - This application is for establishments who DO NOT serve and sell food.
Food BYOB Application - This application is for establishments who serve and sell food.
